            OK...now what is there to prevent another lawsuit???

            SAN RAFAEL, Calif. (Feb. 12) - McDonald's Corp. will pay $8.5 million to settle a lawsuit accusing the fast-food giant of failing to inform consumers of delays in a plan to reduce fat in the cooking oil used for its popular french fries and other foods.
            BanTransFats.com, a nonprofit advocacy group, sued McDonald's in California state court in 2003, alleging the company did not effectively disclose to the public that it had not switched to a healthier cooking oil.

            In September 2002, McDonald's announced it would lower trans fat in its cooking oils and said the switch would be completed in five months. In February 2003, McDonald's announced a delay. The lawsuit accused the Oak Brook, Ill.-based company of failing to adequately inform consumers of that delay.

            The agreement announced Wednesday requires McDonald's to pay $7 million to the American Heart Association to use the proceeds to educate the public about trans fats in foods. Heart-clogging trans fat is made when manufacturers add hydrogen to vegetable oil - a process called hydrogenation.

            Wednesday's settlement also requires McDonald's to spend $1.5 million publicizing that it has not followed through on its 2002 pledge.

            Additionally, the company will pay $7,500 to BanTransFats.com and $7,500 to Katherine Fettke, who had filed a separate complaint against McDonald's and has also agreed to settle.

            McDonald's has reduced the amount of trans fat in its Chicken McNuggets, Crispy Chicken and McChicken sandwiches, said spokesman Walt Riker.

            He said the company is working to reduce trans fat in its other fried foods.

            "We're continuing to test. We want to make sure we get it right for our customers,'' he said.

                Lawyers To 51job.com: You Mean There's Gambling Going On Here?

                How glorious for a Chinese company to be listed in the United States! You have access to all that money from hapless American investors. And you can be a company like 51job (JOBS) with nothing but a website, and if you meet the right investment banking people you gain access to all those tens of millions of American dollars.

                But what the Lord giveth, the Lord taketh away.

                If you haven't heard yet, 51job, the online Chinese job website, delivered a shocking report last week. The CEO, Rick Yan announced on an analyst conference call that there would be much less revenue in the fourth quarter than 51job had originally expected.

                Yan reasoned that this was because Chinese Human Resources departments had somehow all used up their budgets earlier than expected. By December, according to Yan, these HR departments had essentially run out of money and had no more money to spend on 51job's classified ads.

                Investors, very much unconvinced by Yan's reasoning, promptly kicked more than one-third of 51job's market value out of the air. The stock now trades at a shadow of its former high of over US$50.

                And now it is high noon for the American lawyers. Within 48 hours, attorneys from firms all over America purporting to represent aggrieved investors began to issue press releases promising to punish 51job.

                Like the famous "there's-gambling-going-on-here?" Casablanca line, the lawyers were saying, "You mean there's misrepresentation going on with Chinese Internet companies?"

                Whenever a company's stock sharply declines, you can be sure that there will be many American lawyers on standby ready to pounce. But this is especially ridiculous. This is a Chinese Internet company we're talking about. And the market was valuing this company at more than $US 1 billion not too long ago.

                Chinese Internet companies (and pretty much most non-American companies) listed in the United States have a great advantage over similar types of companies doing business in the US. You see, if you are a company like 51job, your stock is being bought and sold by people who know very little of the day-to-day dealings in China. Most of these investors have never walked past a Shanghai subway newspaper stand hawking 51job paper-based classifieds. Most of these investors have never sat in a Beijing mini-bus whose seat cushions are emblazoned with 51job's logo. And most investors know nothing about the daily Chinese-language online forum postings that say both good and bad things about 51job and its rivals like Zhaopin.com, Sohu.com (SOHU), Netease.com (NTES), and the hundreds of other smaller specialized job websites. American investors are in a bubble [sic].

                So if you are an American investor, you rely on the reports issued by analysts in the ivory towers of Shanghai, Hong Kong, and Beijing. You read the news reports from foreign journalists based in China who often need translators to understand what is being said in press conferences and whose greatest desire is to get out of China as soon as possible so they can win a Pulitzer for war coverage in Afghanistan. You rely on the sanitized press releases issued via BusinessWire and PRNewswire on behalf of these listed firms. You are also relying, to a large extent, on the "laws of business" operating the same in China as they do in America. You are hoping that just because "GAAP" is flung around on a Chinese prospectus like a used napkin on the side of a hotpot table that you can get a firm grasp of a business in China.

                China's business environment is constantly shifting. No news report, book, analyst's briefing, or conference call can give a more-than-half picture of the environment on the ground in China's different provinces.

                Many of China's business sectors are booming. But with this boom comes rough seas and unexpected twists. If you are an investor in China's tech sector and you do not expect turbulence, go put your money under a mattress.

                If poor accounting practices are found to blame in 51job's decline, than shame on them. But if their only fault was riding the wave, then shame on the investor.

                  • IIC, could you fix the layout of the text on your site's pages so that the width of the text automatically adjusts to the width of one's browser window. What you have now makes it pretty hard to read the very wide lines of text.

                      IIC, could you fix the layout of the text on your site's pages so that the width of the text automatically adjusts to the width of one's browser window. What you have now makes it pretty hard to read the very wide lines of text.
                      Sorry...I don't know how to do that...Although I will try as you are not the only one who has mentioned it. You must have a monitor of less than 19"???

                      The host I use is really a beginner's type setup...I can mix html with regular type and mix Java/non-Java but I am using the preformatted setup...don't know how to use the Free Form.

                      I will check into it...If you use a a smaller size on your Contol Panel/Display/Settings that would probably do it...but I shouldn't expect people to change their display just for me. I use 1024x768 on a 19" monitor at home and it fits just right. But I know what you mean as I use 800x600 on a 17" monitor at work and it is a pain...although I rarely look at the site at work.

                      There is another alternative I just thought of...I will give it a try next week.

                      • I think you must place the text in an HTML table, or use what are called CSS (style sheets), to determine the minimum and maximum width of the lines of text in a given series of text paragraphs. The result you want is for the width of the text lines to adjust to the width of the browser's window (not to the size of the screen). Look at most websites, and you'll see that the text layout has this feature.

                          I know what you are talking about...but now I need to learn how to do it...But actually, I have had probs in the past with Yahoo forums using a 17" monitor w/ 800x600. Some of the post text is covered by ads...Well...You gave me something to work on...Thx

                              Why the big drop AH?

                              In the report, it mentioned the non-wager website at mainland China. A such web in Hongkong may be a better idea, since horse betting is not legal (at least for now) in mainland. IMHO, this brag can be ignored.

                                Not sure...have not read about the market today yet...worked late. But I bailed on ZICA at 7.70 and UBET at 5.65 before I went to work...held COGT though...I Bot it at 32.16 on 1/5...held through all the carnage...IIC
