River, The biotechs often use me as a whipping boy so I'm sticking to other industries. Saw John Chen of BlackBerry on MSNBC today. It sure looks as if they're recovering well. Would you consider putting and new money in BBRY in the near future ?

Vringo: Next Steps After A Disappointing Decision Versus Google

Aug. 16, 2014 9:58 AM ET | About: Vringo, Inc. (VRNG), Includes: GOOG, GOOGL
Disclosure: The author has no positions in any stocks mentioned, and no plans to initiate any positions within the next 72 hours. (More...)

    Summary

    • Vringo has limited options left to address today's ruling.
    • The best option would be an en banc hearing, which might be granted based on the dispute over the finding of the majority.
    • The verdict today was a huge blow to Vringo, and a clear win in favor of Google, as Google will no longer have to pay damages.

Vringo Inc. (NASDAQ:VRNG) investors got a shock Friday when an appeals court voted 2-1 that the patent Vringo asserted in litigation against Google Inc. (NASDAQ:GOOG) (NASDAQ:GOOGL) was obvious. This news was obviously good for Google investors and helps to prevent Google from paying a verdict which was estimated to be worth hundreds of millions of dollars. This verdict was a huge blow for Vringo, as by finding that the patents were obvious the entire verdict is invalidated, essentially leaving Vringo with not collecting any damages.

This stock is an entirely different animal. It's a patent infringement play. Their product is purely patent enforcement. They totally rely on the US and world courts and systems of justice, the wheels of which turn very slowly and are highly unpredictable. Wouldn't be surprised at all to see this one get to SCOTUS in the not-so-near future. But, in the meantime, the monies from Google awarded by the jury for damages won't be coming. Now the question is whether they will have enough money to keep pursuing all the other worldwide patent infringement cases they are currently working. (See article in next post)

This was my last VRNG trade and when I got out: 04/07/2014 12:35:05 Sold 1000 VRNG @ 3.7601

Plenty of times I hold too long and get greedy.
While I feel for those who took a beating I am admittedly a happy man seeing that I sold timely.

I got out in the middle 4s. Nobody saw that one coming! Congrats to you also. Wow.

Appeals court rules against Vringo; shares halted • 11:13 AM
    • The federal appeals court handling Vringo's (VRNG -10.8%) suit against Google has ruled against Vringo, arguing the patent claims it asserts "disclose no new technology, but instead simply recite the use of a generic computer to implement a well-known and widely-practiced technique for organizing information." (the full ruling - .pdf)
    • The appeals court cites a recent Supreme Court ruling that upheld the patentability of software concepts, but barred companies from patenting a mere abstract idea on a computer.
    • Vringo has been halted. Shares plunged shortly before the halt.

Looks like there been some insider buying within OPK. I've been sitting on this one awhile. You think there may be a move toward that $12. mark, Babe?

Well well well! I copied the guy at Zacks my "beating the.." post on The Sky is Falling. He was initially annoyed that it was "public", but then thought it was hilarious. After I took several more 1000's out of TNA yesterday, and lots more flying emails later, I have just been officially inducted into his Top 10 customer-traders list!!! LOL! Ha! again. Sorry for all the bragging folks, but if Ernie can do it, I need a little fun too.
